Terms and Conditions - Santa & Mrs. Claus Appearances 1. Scope of Services Santa and Mrs. Claus will appear at the designated Event for a pre-determined amount of time. The appearance includes: Santa and Mrs. Claus greeting guests, posing for photos, and engaging in holiday cheer. All performances are conducted with the utmost care, professionalism, and respect for all guests. Santa and Mrs. Claus' Role: Our team will remain in character and participate in the event for the agreed-upon time. We are not responsible for any activities outside of our performance, such as crowd control, food handling, or setup of any event-related features. 2. Client Responsibilities Setup Requirements: The Client is responsible for ensuring the event space is adequately prepared for Santa and Mrs. Claus' appearance. This includes: Seating Arrangement: A suitable chair or throne must be provided for both Santa and Mrs. Claus. Seating must be sturdy, safe, and in place before the performers arrive. Area Setup: The space where Santa and Mrs. Claus are seated must be set up in advance, including any necessary decor, photo opportunities, and seating arrangements for guests. Queue Line Coordination: The Client must handle the coordination of the line or crowd, including organizing guests and maintaining an orderly flow. Safety Measures: The Client must ensure that the event area is safe for all attendees, including preventing any hazardous conditions or obstacles in the seating area. Decor: Any decorations, props, lighting, or additional items used for the event must be organized and set up by the Client. Our team will not be responsible for the setup or adjustment of decor. 3. Event Schedule The start time and duration of the appearance will be agreed upon in advance. Santa and Mrs. Claus will arrive at the Event at least 15 minutes prior to the scheduled start time for a brief preparation. If there are any delays or changes to the Event schedule, the Client must inform the Santa and Mrs. Claus Team as soon as possible. We will do our best to accommodate any changes, but are not responsible for delays caused by external factors. 4. Payment and Cancellations A deposit of [Insert Amount] is required to confirm the booking. Full payment is due [Insert Amount of Time] before the event date. Cancellations made less than [Insert Number of Days] before the Event may incur a cancellation fee of [Insert Fee]. In the event of an unavoidable emergency (e.g., illness, extreme weather), the Santa and Mrs. Claus Team will make reasonable efforts to reschedule the appearance or offer a full refund. 5. Liability and Indemnification The Client agrees to indemnify and hold harmless the Santa and Mrs. Claus Team, including our performers and any associated staff, from any liability arising out of the Event, including: Any accidents, injuries, or damages to persons or property during the Event. Any damage to the venue caused by the Client’s failure to provide a safe, prepared space. The Santa and Mrs. Claus Team will not be held liable for any damages caused by factors outside of our control, including but not limited to venue conditions, weather, or accidents involving other event participants. 6. Rights to Use Photos and Videos The Client acknowledges that photos and videos may be taken during the Event. By booking the appearance, the Client grants permission to the Santa and Mrs. Claus Team to use any images or recordings for marketing, promotional, and social media purposes. The Client may request not to have photos/videos shared, but the Santa and Mrs. Claus Team is not obligated to comply with such requests. 7. Conduct of Guests The Client agrees to ensure that all guests at the Event conduct themselves respectfully and in accordance with common decency. Santa and Mrs. Claus reserve the right to discontinue the appearance if any guests engage in disruptive or inappropriate behavior. 8. Force Majeure Neither party will be held liable for failure to perform obligations under this Agreement if such failure is due to unforeseen circumstances beyond reasonable control (e.g., severe weather, natural disasters, government restrictions, etc.). 9. Entire Agreement This Agreement constitutes the entire understanding between the Client and the Santa and Mrs. Claus Team regarding the Event. No other representations, promises, or terms will be valid unless made in writing and signed by both parties. By checking the Terms & Conditions box, the Client acknowledges and agrees to the terms and conditions set forth in this Agreement.
